Terms of service

These terms are an agreement between you and Promptly AI Private Limited (“we”, “us”, “our”), the company that operates GetMarketty, registered office 128N/2C Bhola Ka Pura, Prayagraj (Allahabad), Uttar Pradesh 211001, India. By creating an account or using GetMarketty you accept them. If you use GetMarketty for a business, you confirm you are authorised to accept these terms for it.

GetMarketty is an AI digital marketing platform. It drafts campaigns from your offer, publishes the campaigns you approve to your own Meta and Google ad accounts, captures the enquiries they bring in, helps you follow up, and reports results.

Review AI-generated plans, ads, creatives and first-email drafts before approving them. AI output may be inaccurate, incomplete or unsuitable for your business, and it does not guarantee sales, leads, revenue or advertising approval. Automated messaging and calling operate only when you enable them, under the instructions, consent checks and controls you configure.

You must be at least 18 and able to enter a binding contract. Keep your sign-in details secure and tell us at once if you suspect misuse. You are responsible for activity under your account.

You connect your own Meta, Google, WhatsApp and CRM accounts. Your use of them is also governed by those providers’ terms and advertising policies, and they may review, reject or limit your ads or accounts.

Ad spend is billed by Meta and Google directly to you under your own ad accounts. Our plan prices never include or mark up ad spend. Campaigns are created paused and go live only after you approve their platforms, budgets and dates; automation stays inside the limits you approve.

You must not use GetMarketty to:

• advertise anything illegal in India, or anything Meta’s or Google’s advertising policies prohibit;
• run political or social-issue ads, or online gambling or real-money gaming ads;
• message people who have not agreed to hear from you, or ignore an opt-out — WhatsApp messages go only to people who opted in, and you must follow the WhatsApp Business Messaging Policy and applicable TRAI regulations;
• upload content you have no right to use, or content that is false, misleading, defamatory or harmful;
• probe, overload or work around the security or limits of the service.

You own your business content, leads and customer records. You give us permission to process them only to provide the service to you. For your customers’ personal data, you are the data fiduciary and we process it on your instructions; you are responsible for having a lawful basis, such as consent, to collect and use it.

You can export your records and disconnect integrations at any time.

Promptly AI Private Limited owns or licenses the GetMarketty software, interface, branding and service materials. Your plan gives you permission to use the service for your business within these terms; it does not transfer ownership of the platform to you.

You retain your rights in content and records you supply. You must have permission to use any uploaded text, images, audio, trademarks or other material. AI-generated content may not be exclusive, and you remain responsible for reviewing its accuracy and your rights to use it.

Plan features, limits and prices are shown on the pricing page when you buy. GetMarketty has a Free plan and paid Pro and Ultra plans. Paid plans are paid once, in advance, for a year, and do not renew automatically. Prices are shown excluding GST; GST at the applicable rate (currently 18%) is added at checkout. Before paying you give us your billing name, address and state, and your GSTIN if you are registered.

Every payment gets a GST tax invoice, and every refund of an invoiced amount gets a credit note. You can view them on the Billing page.

Renewal is always your choice. We email you 30, 7 and 1 day before a paid year ends. Renewing the same plan early adds a full year after your current end date, so no paid day is lost. Switching to a different paid plan starts it on the day you pay, and the unused part of your current plan is converted, by value, into extra days on the new plan.

When a paid year ends without renewal, your account moves to the Free plan. Nothing is deleted: your leads, campaigns and other data stay, and Free limits apply from then on — anything above them keeps working, but you cannot add more until you renew.

Payments are processed by Razorpay. If a payment fails, we may pause paid features until it succeeds.

Paid plans do not renew automatically and we never charge you without your action. Refunds follow our Cancellation and Refund Policy.

We work to keep GetMarketty available but do not promise uninterrupted service. Meta, Google and other providers can change or withdraw their APIs; we may have to change features as a result. We will tell you in advance of changes that materially reduce what your paid plan includes.

We may suspend or close an account that breaks these terms, a provider’s policy or the law, or that puts other users or the platform at risk; where we can, we will warn you first. You can request account closure through our support team and export available records beforehand. Data deletion and legally required retention follow the Privacy Policy.

To the extent permitted by applicable law, the service is provided as available, and we do not promise that it will be uninterrupted, error-free or achieve a particular commercial result. We are not liable for indirect or consequential loss, such as lost profit or opportunity, arising from use of the service.

To the extent permitted by law, our total liability arising from the service is limited to the fees you paid us for it in the 12 months before the event giving rise to the claim. This does not exclude liability for fraud, wilful misconduct or any liability or statutory right that cannot lawfully be limited. The same protections apply to any rights you have under mandatory consumer law.

We are not responsible for the decisions of Meta, Google or other providers about your ads or accounts, or for results your campaigns do or do not achieve.

These terms are governed by the laws of India. Please contact our Grievance Officer first so we can try to resolve a dispute. Subject to mandatory law and any non-waivable right to use another court, tribunal or authority, courts at Prayagraj, Uttar Pradesh have jurisdiction.

We will tell you before material changes take effect. Continuing to use GetMarketty after that means you accept the updated terms.
